1. Introduction
Welcome to CommonsDataGateway ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at commonsdatagateway.top (the "Service") operated by CommonsDataGateway.
By reserving a charter or utilizing our Service, you consent to these Terms. Should you not agree to any section of these terms, you are prohibited from using the Service.
2. Service Overview
CommonsDataGateway offers top-tier yacht charter services, which include among others:
- Yacht rentals for a day
- Evening sailing trips
- Business getaway events
- Private celebrations
- Extended yachting experiences
All offerings are subject to current availability and meteorological conditions. We retain the right to alter or cease our services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For a successful charter reservation, you must:
- Be 18 years of age or older
- Provide precise and comprehensive details
- Submit the required advance payment as noted in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Confirmation of your reservation takes place only after we receive your payment and issue a formal confirmation. We hold the right to decline service to any individual at our discretion.
3.3 Availability
All yachting excursions are conditional upon the availability of vessels and favorable weather. We shall exert reasonable efforts to accommodate your requested dates and hours.
4. Payment Terms
4.1 Pricing
All charges are presented in € and incorporate all relevant taxes unless specified otherwise. Prices are liable to change without forewarning.
4.2 Payment Schedule
- Initial fee: 50% of total charter cost payable upon reservation
- The remainder: Payable 48 hours before the departure of the charter
- Incidental charges (if applicable): Payable upon charter completion
4.3 Payment Methods
Major credit cards, direct bank transactions, and accepted checks are our methods of payment. Payments are securely processed via encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Complete refund minus transaction fees
- Between 24 and 72 hours before departure: 50% of the cost is refunded
- Under 24 hours before departure: Non-refundable
5.2 Weather Cancellations
Should our captain judge weather conditions as unsafe, we propose to:
- Reschedule the charter at no extra cost to the nearest possible date
- Issue a full refund if rescheduling is not achievable
5.3 Mechanical Issues
In case there are technical issues with the assigned yacht, we will try to offer a comparable alternative. If a substitute is not available, a complete refund will be provided.
6. Safety and Conduct
6.1 Safety Requirements
Passengers are required to:
- Adhere to all instructions from the crew
- Utilize safety gear when mandated
- Disclose any health conditions that may impact their safety
- Stay within the designated areas on the yacht
6.2 Prohibited Items
The following are forbidden onboard:
- Containers made of glass
- Unlawful substances
- Firearms or other weapons
- Non-prescription drugs in excessive quantities
- Pets (except when permission is obtained beforehand)
6.3 Conduct
Individual behavior should be considerate and respectful at all times. A charter may be ceased prematurely without a refund if passenger conduct is deemed a safety hazard or interrupts others' experiences.
7. Liability and Insurance
7.1 Our Liability
Our responsibility is limited strictly to the fee paid for your charter. We are not accountable for:
- Injuries sustained through passenger negligence
- Theft of or damage to personal belongings
- Any indirect, resultant, or punitive damages
- Hindrance due to weather or situations not within our control
7.2 Insurance Coverage
Our operations and vessels are covered by comprehensive marine insurance. It is your duty to secure personal and travel insurance.
7.3 Assumption of Risk
By participating in our services, you acknowledge and take personal responsibility for the inherent risks associated with marine activities and for your safety and well-being.
8. Modifications and Itinerary Changes
Modifications to itineraries, paths, or schedules may be necessary due to weather, safety, or operational requirements. We will make every effort to offer comparable substitutions.
9. Force Majeure
Delays, disruptions, or changes caused by forces beyond our control, including, but not limited to, the following events, are not in our realm of liability:
- Extreme weather phenomena
- Natural catastrophes
- Statutory dictates
- Closures of seaports
- Mechanical breakdowns
10. Privacy and Data Protection
Your private information is secured following our Privacy Policy. Using our services indicates your consent to gathering and using your data as outlined in the Privacy Policy.
11. Intellectual Property
Copyright and trademark statutes protect the materials on our website, including wording, imagery, marks, and icons. Reproduction, distribution, or derivation without express authorization is prohibited.
12. Governing Law
The laws of Spain govern these Terms. Any legal proceedings must be conducted in the courts situated in Barcelona, Spain.
